Wills & Power of Attorneys are both documentary expressions of the desires of a person.
Wills reflect the distribution and authority of control of an individual’s property after their death. A Will is an important document regardless of an individual’s status, as married or single, with or without children. Without the existence of a proper Will, the Law of Ontario (for residents of Ontario) supersedes on who becomes the recipient of the money and property of a deceased person.
Through a Power of Attorney, someone else can be given the right to make decisions or act on behalf of the grantor. There are two main types of powers of attorney:
- Continuing Power of Attorney for Property
- Power of Attorney for Personal Care
Wills and Power of Attorneys both should be carefully written as a document because any clause that may be characterized as unlawful (either fully or partially) may result in incomplete execution of the wishes of the grantor. Notary Public
For All Your Notary Needs
We notarize and certify all kinds of documents. Document can be notarized for use in Ontario, outside Ontario, or even out of Canada for different purposes. We have notarized a lot of documents our clients used out of Ontario or Canada. Documents can be in any language including foreign languages. In most cases the job of Notary is to properly identify you, and witness you sign the document. For identification purposes, the Notary will require you to present a Government issued photo identification document such as a driver licence, passport, PR card, citizenship certificate or other similar document. The document must bear your full name and photograph.
By law, the person having their signature notarized must physically appear and sign in front of the Notary. If your document needs an extra witness, please bring someone with you. If you are unable to bring an independent witness we can arrange someone from our office, which will cost you extra.
